WITH THE PASSAGE OF THE AMERICA INVENTS ACT, IT IS NOW MORE CRITICAL THAN EVER TO FILE PATENT APPLICATIONS AS SOON AS POSSIBLE.
The America Invents Act makes several changes to US patent law. Most significantly, the law changes who is entitled to a patent. Under the previous law, the first inventor to invent is entitled to the patent. Under the new law, with limited exceptions, the first inventor to file a patent application is entitled to the patent, regardless of who is first to invent.
Once this change takes effect, it will be absolutely critical to file patent applications as soon as possible.
